TERMS AND CONDITIONS OF USE OF THE MAX WHITE RECORDS SITE AND GENERAL CONDITIONS OF CONTRACTS ENTERED INTO THROUGH THE STORE

 

I. OBJECT

These "Terms and Conditions" are intended to clarify users of the virtual commerce service ("E-Commerce") provided by Max White Records SAS ("Max White Records")  through the websitehttp://www.maxwhiterecords.com("Max White Records") the general conditions that must be respected by both users and in transactions carried out through Max White Records. It is the duty of all users of the websitehttp://www.maxwhiterecords.comread this document correctly.

 

For the acquisition of products offered by the Max White Records website, the acceptance of the Terms and Conditions described below is a mandatory requirement.

II. PRIVACY POLICY

IV. CONTRACT MODIFICATION / COMPLEMENTATION POLICY

 

Prior to purchase, Max White Records. will present the user with a "screen" with a summary of the terms of the contract (for example: mail, address, telephone, city, quantity of products, size, color and price of the product, total price, conditions and costs of delivery and payment, ). At this time, the user must pay close attention to the terms contained therein, such as, for example, the delivery address and the characteristics of the product (size / color / gender / type of beat / library).

 

This is because this will be your last chance to change/amend possible errors. As long as the purchase is not finalized by the user, the price and availability of the products may be modified. Once this "screen" is confirmed and the subsequent completion of the purchase, Max White Records will send the user an email confirming the contract, now definitive. Said email will have the information of the delivery time, exact price, including taxes, shipping costs and the way in which the payment was made.

 

For security reasons, Max White Records will not change the delivery address or user registration data once the purchase is complete under any circumstances.

 

Once the purchase is completed, the products will be delivered to the address indicated by the user.

V. PAYMENT POLICY

The user can pay for the products by the following means:

Debit or credit cards: Visa, MasterCard, American Express, Diners Club and Codensa.

Bank debit: PSE.

Cash Payment: Via Baloto, Pay Everything, Efecty, Nequi, Daviplata.

Purchases may be subject to a fraud check process by Max White Records' payment service provider and may therefore be delayed. Likewise, they can be postponed for a while for a more rigorous investigation, to avoid fraudulent transactions.

 

SAW. DELIVERY POLICY

 

The prices published in Max White Records do not include shipping cost, unless expressly indicated in a particular product or promotion. Max White Records reserves the right to change prices without notice.

 

Term

Shipments will be made by Max White Records through the allied carrier Envía Internacional, or the one designated later for this purpose. To know the status of the shipment and track the order, the user must write to the WhatsApp line +57 3134665521.

 

For pre-order products, allow up to 45 days for shipping from the release date indicated on the product page. You should also consider the days for shipping that are from 2 to 5 days if you are in Bogotá or from 8 to 20 days if you are outside of Bogotá.

 

The delivery time once the order has been processed and paid, will be as follows:

 

Deliveries in Bogotá between one (1) and eight (8) business days.

Deliveries to the rest of the country between five (5) and twenty (20) business days.

Holidays are NOT considered business days. 

 

Schedule

Purchases made after 5:00 pm will be processed, packed, and delivered to the carrier the next business day.

 

The transport company will make the delivery from Monday to Saturday between 9 am and 7 pm. Not valid on holidays.

Location

The place of delivery will be chosen and confirmed by the user (see title "IV" above).

 

Attempts

Max White Records, through the transport company, will make three (3) delivery attempts solely and exclusively at addresses other than residential complexes or buildings with a concierge service. In residential complexes or buildings with concierge service, the User accepts that deliveries may be made to the guard or receptionist who is on duty.

 

Likewise, no second delivery attempt will be made in these cases.

 

  1. Recipient name does not match

  2. Sender's instruction to stop sending

  3. Recipient address not found or incomplete

  4. At the delivery address they do not know the recipient or transfer

  5. They do not know the sender at the delivery address

  6. Prior appointment with the recipient to deliver the shipment (subject to Malla)

  7. They do not receive for quarantine

  8. Failed attempts/retries

If none of these three delivery attempts is successful or is within the list of options related in point 4, the product will be transferred to the transporter's facilities and Max White Records will contact the user via email to find a solution and be able to deliver. The user must respond within ten (10) calendar days following receipt of the communication.

If the user responds within the established term and the delivery is made successfully, the User will not have to assume any cost for the new shipment.

 

After ten (10) calendar days without obtaining a response from the user, the transport company will return the product to Max White Records, only after the user has confirmed the address through the contact in the "Contact Channel", the transport company a new attempt will be made in this case, the delivery period will be counted again from the confirmation of the address and the user must assume the shipping cost.

Product reception

The product will be delivered to people of legal age. Whoever receives the product must sign the guide with identification number. B. Product Rejection Procedure

 

Max White Records packs the products so that they do not suffer damage during the transport process.

 

Upon receiving the product, the user must verify the conditions of the respective packaging; if it is damaged in any way (for example, scratched, torn, or open), you must:

Refuse to receive the product; indicating in the delivery guide the reason for the refusal, between: "damaged packaging"; "Defective product"; "product not in accordance with the order" or "lack of accessories", e; (ii). Inform Max White Records. if it is not immediately, within 72 hours after the rejection of the shipment, requesting the return of the payment or exchange of the product. The User must make the request to the Contact Channels indicated in section VIII.

 

After 72 hours no claims will be accepted or changes or refunds will be made for Damaged packaging.

 

Conduct of carriers / couriers

Shippers/distributors of Max White Records products are prohibited from:

 

Enter the house;

Open, assemble, install and/or repair products;

Deliver products to an address other than the one listed on the transport guide;

Deliver products to minors or without identification document;

possible eventualities

Max White Records is not responsible for possible delays resulting from unpredictable and/or irresistible situations, such as heavy rains, floods, accidents and/or strikes in the region where the product must be delivered, which make it impossible for the carrier to arrive.

 

VII. RETURN POLICY / PRODUCT EXCHANGE

Return / exchange of product for damage to its packaging

 

A. Damage verified upon receipt of the product:

 

As already mentioned in the title “VI. 6. B. " above, if the user perceives any damage to the product packaging (includes: cracks, tears or openings), he must:

 

(i) Refuse to receive the product; indicating in the respective shipping guide the reason for the refusal, between: "damaged packaging"; "Defective product"; "product not in accordance with the order" or "lack of accessories" e;

 

(ii) Inform Max White Records, if not immediately, within 72 hours after the rejection of the shipment, requesting the return / exchange of the product. The User must make the request to the Contact Channels indicated in section VIII.

 

After 72 hours no claims will be accepted or changes or money refunds will be made for damaged packaging.

B. Damage found after receiving the product:

If the damage is found after receiving the product, the user must contact Max White Records, within a maximum period of 30 (thirty) days, requesting the return / exchange of the product. The user must make the request to the Contact Channels indicated in section VIII. The transport costs that are generated will be in charge of Max White Records.

After 30 (thirty) days, claims will not be accepted or changes or refunds will be made for defective product, product not in accordance with the order or lack of accessories.

Return / exchange of product by "retraction" by the user (consumer)

The user may, in exercise of his "Right of Withdrawal", cancel the purchase and / or terminate the contract and, consequently, change or return the product, within 05 (five) business days from the receipt of the products. The user may not exercise the right of withdrawal in the situations indicated in article 47 of the Consumer Statute, and especially, in the case of Merchandising for personal use.

 

Max White Records will return to the user all amounts paid within thirty (30) calendar days from the moment the right was exercised. Max White Records will send an email to the user, confirming the exercise of the right of withdrawal.

 

After 5 (five) days, the Consumer will lose the right to retract the purchase, in which case Max White Records will not make refunds

 

The transportation costs generated will be borne by the user.

 

In the event that the user wishes to retract the purchase made at Max White Records, they must direct their request through the contact channels indicated in section VIII.

 

Return / exchange of the defective product.

The user can request the exchange of a defective product, for this purpose the user must contact Max White Records, within a maximum period of 30 (thirty) days, requesting the return / exchange of the product. The User must make the request to the Contact Channels indicated in section VIII.  The transportation costs generated will be the responsibility of Max White Records

 

After 30 (thirty) days, claims will not be accepted or changes or refunds will be made for defective product, product not in accordance with the order or lack of accessories.

 

General conditions for the return / exchange of products:

In the event that the product is returned due to retraction or defect, the customer must contact Max White Records for instructions on how to return the products by mail.

 

Failure to comply with one of the following conditions will result in Max White Records refusing to "return/exchange" products:

The products will be subjected to an exhaustive technical analysis by the quality sector of Max White Records, within 15 (fifteen) calendar days following their receipt, and in the event that "misuse" by the user is verified, there will be no refund of the amount paid or the change of the product and the damaged product will be returned to the user assuming the user the transportation costs. Only after this analysis, if it is verified that there was indeed no misuse of the product, the terms for the return of the payment and / or change of the product will begin; in this case the transportation cost will be borne by Max White Records

 

 

VIII - RESOLUTION POLICY FOR REQUESTS, QUESTIONS, CLAIMS AND REQUESTS FOR PURCHASE SUSPENSION AND CANCELLATION

Without prejudice to the contact channels provided, the user may freely access the "Questions and Answers" link available on the website, in order to immediately resolve possible frequent doubts.

IX. IDENTIFICATION AND CONTACT DETAILS.

(B) not to use the Website for the transmission or publication of any computer virus or any material that is defamatory, offensive or of an obscene or threatening nature, or in such a way that it causes annoyance, inconvenience or damage to third parties;

(C) not to use the Website in a way that constitutes a violation or infringement relating to any person, firm or company (such as regarding copyright or confidentiality);

(D) not to use the Website to transmit any material for promotional and/or publicity purposes without the prior written consent of Max White Records.

(E) if any User has the right to sue, claim or bring an action against any other user that arises from the use of the Website, they will exercise said claim exclusively against that third party, exonerating Max white Records from any responsibility.

THE WEBSITE

The User accepts and acknowledges:

(A) that it is technically impossible to make the Website available free of errors and, therefore, Max white Records is not responsible for possible errors;

(B) that failures may lead to the temporary unavailability of the Website;

(C) that the operation of the Website may be negatively affected by conditions and actions that are not under the control of Max White Records, such as the transmission and telecommunications links between Max White Records and Users, between different parts of Max White Records and other systems and networks.
